Timothy P. Flanagan

Timothy FlanaganTim Flanagan is an associate attorney with the firm, where he serves as both general and litigation counsel for community associations.  Tim has focused his practice on the representation of community associations since 2010.  In 2010, he was nominated as a “Rising Star” in the industry by the Orange County Chapter of the Community Associations Institute (“CAI”).

As corporate counsel, Tim advises boards of directors on the interpretation and enforcement of governing documents, the preparation and analysis of contracts, leases, easements and other agreements, compliance with FEHA and ADA, drafting amendments and restatements of governing documents, compliance with the Davis-Stirling Common Interest Development Act, Corporations Code, and all other matters affecting community associations.

As litigation counsel, Tim has successfully litigated breach of contract matters, architectural enforcement issues, encroachments, nuisances and rental restriction violations.  Tim has also defended community associations against homeowner disputes, and has successfully negotiated several settlements through the alternative dispute resolution (“ADR”) process outlined in the Davis-Stirling Common Interest Development Act. 

Tim earned his Bachelor of Arts Degree in Speech Communications from the University of Minnesota in 1996.  In 2006, Tim earned his Juris Doctor degree from California Western School of Law, where he was the recipient of the Dean's Merit Scholarship.  Tim has been a member of the California State Bar since 2006, and is admitted to practice before all courts in the State of California as well as the Federal District Courts for the Southern, Central and Northern Districts of California.

Tim is an active member of the CAI where he serves as the Chair of the Education Committee for the San Diego Chapter of CAI.  Tim has presented several community association law classes for the Orange County and San Diego Chapters of CAI, and in 2011 was nominated as “Speaker of the Year” by the Orange County Chapter of CAI.  Tim has written several articles on community association law in publications throughout Southern California.   Tim is also a member of the California Association of Community Managers and the San Diego County Bar Association.
